The Surf and Win Sweepstakes (the "Sweepstakes") consists of a series of overlapping promotional Giveaways, each with a fixed number of Prizes to be awarded over a specified Promotional Period, in which participants qualify to win Prizes by using a commonly available Internet Search Engine. Every Giveaway is subject to these Official Rules and the Terms of Service for this Website except as expressly stated otherwise. No purchase necessary to enter or win. A purchase or payment will not increase your chances of winning.
Eligibility :
The Sweepstakes is open to residents of the United States, Canada and United Kingdom, [Void where prohibited] who are at least thirteen (13) years old and have an Internet connection. Employees of the Sponsor and any Promoter and their affiliates, Sweepstakes supervisors and members of their immediate families are not eligible to participate or win. To Enter the Sweepstakes :
To enter the Sweepstakes, just browse the site BigDevil.com and surf any of the web pages. Each time you surf a specific link, you will be eligible to win a prize. Clicking through to any other linked pages, including sponsored results and search results will not result in additional Sweepstakes entries. No more than 30 to 50 (depending upon your Membership status) browsers per day will be eligible to win.

Winner Selection Methodology: Computer-generated potential winning time(s) will be randomly selected for all prizes. If you are the first person to surf at or after a winning time, you will win a prize. Winning times will be generated consistent with user traffic estimates and may not be evenly distributed throughout the Promotional Period ("Instant Win Method").
How to Claim a Prize :
You will be notified immediately if you have won a Prize. To claim your Prize, you must follow the instructions in your notification. Failure to timely and properly claiming of any Prize will result in forfeiture. All personally-identifiable information submitted by any winner to claim a Prize is subject to Sponsor's Privacy Policy
If the Prize is presented as a motor vehicle: Any Sales Tax, title and license fees, Registration and Insurance fees, as well as other costs of claiming, operating or owning the vehicle, are the sole responsibility of the winner. Winner must claim the vehicle at an authorized dealership within Winner's State and (if any) County of residence, and must take delivery within 90 days of winning from existing dealer stock of new vehicles. Neither the Sponsor nor any Promoter is responsible for any warranties, representations or guarantees, express or implied, in fact or law, relating to the vehicle, including but not limited to its quality, mechanical condition, merchantability or fitness for a particular purpose. Winner takes possession of the vehicle when Winner drives it off the lot. Prior to taking possession of the vehicle, Winner will be required to present a valid Driver's License and proof of Insurance.
Winner Verification; Prize Receipt :
Winners may be required to show verifiable proof of legitimate search and entitlement to win and to sign an affidavit of eligibility and publicity release in order to claim their Prize. If you have not received your Prize within 4 weeks after the end of the relevant Promotional Period, you must notify the Sponsor at support@bigdevil.com. Failure to notify the Sponsor of non-receipt within eight weeks after the end of the Promotional Period will result in forfeiture of the Prize.
Publicity :
Participation constitutes consent to use the Winner's name, likeness and address (city, state) for promotional purposes in any media, worldwide, without further payment or consideration.
General Conditions :
Any Giveaway may be canceled, suspended and/or modified, in whole or in part, if in the opinion of the Sponsor any fraud, technical failure or other factor beyond its control impairs the integrity or proper functioning of the Sweepstakes. Neither the Sponsor nor any Promoter is responsible for computer malfunctions, network connections, email delivery problems, systems failure or incompatibility, typographical, technical or key-stroke errors, or interruptions in Internet service.
Prizes may be offered in different promotional presentations, combined with other Prizes or substituted with another of comparable or greater value. (For example, a $10 Prize may be offered or fulfilled as cash, a gift card or merchandise of comparable value.) No other cash option for, or substitution, assignment or transfer of, any Prize is permitted. Claimed Prizes will be awarded within two to four weeks. Unclaimed Prizes will not be awarded. Winner is responsible for all taxes. Sponsor reserves the right, in the case where all Prizes have been awarded prior to the scheduled end of the Promotion Period for any Giveaway, either to end the Giveaway or to replace some or all of such Prizes and continue.
Only the first 25 legitimate searches across all Promoter Websites (as defined in Section 10 below) each day during the Promotional Period will qualify as entries (the "Daily Entry Limit"); any additional searches will not be eligible to win. All days begin at 12:01am CST and end at 11:59 pm CST on the date specified in each Giveaway. Searches for the same word, or for the letters of the alphabet, and other irrelevant search queries and similar schemes, will not be deemed to constitute legitimate searches. You may not enter with multiple identities or use any automated system or other device or artifice to enter or obtain more than the maximum number of qualified entries. If the Sponsor changes the number of qualifying searches per day, or chooses to shorten the Promotion Period, the winner must provide at least one day's prior notice through these Official Rules. You and your entries may be disqualified if you attempt to circumvent these Official Rules or the Terms of Service of this Website.
Limitations of Liability :
If for any reason an entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, the entrant's sole remedy is another entry in the same or a comparable Sweepstakes (or, if that is not possible for any reason, in a random drawing from among other eligible entries for any or all of the unclaimed prizes offered in a Giveaway). No claimant in any dispute involving the Sponsor or any Promoter shall be entitled to claim or obtain indirect, punitive, incidental or consequential damages. Liability of the Sponsor or any Promoter on a claim is limited to the value of the Prize in question.
Disputes :
Decisions of the Sponsor's Board of Judges are final. In the event of a dispute as to any entry, the authorized account holder of the email address, used to conduct a surf, will be deemed to be the entrant. Failure by the Sponsor to enforce any provision in these Official Rules shall not constitute a waiver of that provision.

Any action related to this Agreement will be governed by Illinois law, excluding (1) principles of conflicts of laws, and (2) the United Nations Convention on Contracts for the International Sale of Goods. Any action relating to this Agreement shall be brought in the state or federal courts located in the Northern District of Illinois, and you hereby submit to the exclusive jurisdiction and venue thereof. You agree to comply with the laws of Illinois and the United States that apply to the use of this Service and the compensation you may receive. If the law of your country, state, or province of residence prohibits or limit Your participation in this Service, then You are responsible for complying with such laws and you agree to indemnify BigDevil.com against any breach. If any part of this Agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect. This Agreement is personal to you and you may not transfer, delegate, or assign this Agreement, your referral network, your BigDevil.com account or other benefits you receive as a 'BigDevil.com Member' to anyone. Any attempt by you to assign or delegate this Agreement shall be null and void. BigDevil.com may assign this Agreement at its sole discretion.
Sponsor; Promoters :
The Sweepstakes is sponsored by Big Devil Inc., 1540 Dundee Rd, Suite 104, Palatine, il -60074. The Sponsor may contract with others (each, a "Promoter") to make the Sweepstakes available through surf and Win opportunities offered on their respective Websites (each, a "Promoter Website"). All Participants have the same chance to win and the Daily Entry Limit applies at all times regardless of the Promoter Website through which they enter. The Sponsor and some Promoters may offer additional benefits or features to Participants, but such benefits or features are independent of the Sweepstakes, not affecting the odds of winning a Prize and are not the responsibility of any other person.

For Sweepstakes results and/or a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to the Sponsor at the address above within thirty (30) days after the end of the Promotional Period. VT and MA residents may exclude return postage.
